TERMS AND CONDITIONS FOR ORDERING GENETIC TESTS
- Chapter 1. General Provisions
- These Terms and Conditions ("Terms") define the rules for customers to order genetic testing services using the website diagnostyka.genomed.pl, operating at https://diagnostyka.genomed.pl.
- The Administrator of this website is GENOMED S.A., with its registered office in Warsaw at 12 Ponczowa Street, entered into the Register of Entrepreneurs maintained by the District Court of the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0000374741, with share capital of PLN 132,130.10, fully paid up, Tax Identification Number (NIP) 7010083563, and National Business Registry Number (REGON) 141108082.
- The following definitions are used in these Regulations:
- Customer – a natural or legal person placing orders via the website https://diagnostyka.genomed.pl, by phone or by sending an order to an email address.
- GENOMED S.A. – a company with its registered office in Warsaw at 12 Ponczowa Street, entered into the Register of Entrepreneurs, maintained by the District Court of the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0000374741, with share capital of PLN 132,130.10, fully paid up, Tax Identification Number (NIP) 7010083563, and National Business Registry Number (REGON) 141108082.
- NZOZ GENOMED – Non-Public Health Care Center GENOMED, performing genetic testing on behalf of the customer.
- Business Days – weekdays from Monday to Friday, excluding public holidays.
- Order Processing Time – the time within which NZOZ GENOMED will perform a given test, counted in business days from when the collected biological material is delivered to NZOZ GENOMED.
- Order Fulfillment Time – the time within which GENOMED S.A. will deliver the ordered biological sample collection kit to the customer. The timefarme for delivery is calculated from the order placement date to the delivery date of the collection kit to the address provided by the customer.
- Kit – a kit for self-collection of biological material necessary to perform genetic testing.
- Order – a declaration of intent by the customer, directly leading to the conclusion of a Distance Sale Agreement via the website or by telephone, or email, specifying the type and quantity of the service ordered.
- Additional service – a service provided by GENOMED S.A., consisting in the preparation and delivery to the Customer of data from the molecular analysis performed, which are the basis for the genetic test result issued.
- Terms and Conditions – these terms and conditions for ordering and performing genetic testing.
- Chapter 2. Rules for the provision and use of services
- Genetic testing services are sold by GENOMED S.A. on the website available at https://diagnostyka.genomed.pl
- GENOMED S.A. sells genetic testing services through the website available at https://diagnostyka.genomed.pl, the full list of genetic tests can be found on the website at the aforementioned address in the "Genetic Tests" tab.
- NZOZ GENOMED conducts genetic tests by analysing the Customer's biological material.
- To perform a genetic test by NZOZ GENOMED, a sample of the biological material for testing must be provided by the Customer.
- The Customer may provide biological material for genetic tests by:
- making an appointment in NZOZ GENOMED office at ul. Ponczowa 12 in Warsaw to collect a sample of the biological material,
- ordering a kit for the self-collection of biological material and a genetic test.
- GENOMED S.A. accepts orders for genetic testing via:
- the form available on the website https://diagnostyka.genomed.pl
- by phone at +48 22 498 2 498, +48 22 644 60 19 (opening hours: 9:00 a.m. to 4:30 p.m. on business days)
- by email: diagnostyka@genomed.pl
- The kit is being ordered by the customer along with the selected genetic test order.
- The form available at https://diagnostyka.genomed.pl is used to place an order for a kit and for a genetic test.
- The basic requirement for fulfilling a genetic test order is the correct completion of the order form, payment and delivery of the biological material sample along with the order form:
- for individual patients – a completed and signed genetic testing request form with informed consent;
- for physicians or centers referring patients for testing – a completed and signed declaration of informed consent to genetic testing, along with a referral form for general examinations or a referral form for infertility testing.
- Forms indicated in points 9(a) and (b) are available on the website https://diagnostyka.genomed.pl in the " How to Have Genetic Testing Performed?" tab in „Fill in the form” part.
- Ordering a genetic test, the customer must complete the form fields marked with an asterisk, providing personal data necessary for the medical diagnostics. Optionally, the customer may also complete the "Test code" form field. Providing the test code on the form is not required, but it may speed up the execution of the order.
- Pursuant to the Polish Regulation of the Minister of Health of June 30, 2025 on quality standards for laboratories (PJoL 2025 item. 961), a genetic test order must include the signature and identification of the physician ordering the test.
- GENOMED S.A. declares that it processes customers' personal data in accordance with Article 13, paragraph 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation (GDPR)), and that it applies technical and organisational measures to ensure the protection of processed data appropriate to the risks and categories of data being protected, and in particular protects customer personal data against unauthorised disclosure, loss, or damage.
- Only authorised employees or associates of GENOMED S.A. and authorised persons who have been granted appropriate powers of attorney have direct access to personal data collected by GENOMED S.A.
- Customer personal data may also be made available to entities authorised to receive them under applicable law, in particular the relevant judicial authorities.
- Each order is confirmed by GENOMED S.A. by email or phone. An order that has not been confirmed has most likely not been received due to technical reasons. The customer is then asked to contact us.
- Properly placing an order on the website https://diagnostyka.genomed.pl constitutes the conclusion of a sales contract, obligating NZOZ Genomed to perform the ordered genetic test and the customer to pay for the purchased service.
- Prices for particular tests are listed in the tables on the website https://diagnostyka.genomed.pl (the „Test list” tab).
- Along with or after placing an order, the Customer may request GENOMED S.A. to perform an Additional Service. GENOMED S.A. will perform the Additional Service upon completion of the Service or within 14 days of the date the Customer places an order for the Additional Service. The cost of performing the Additional Service is 300 PLN plus 23% VAT. Payment for the Additional Service must be made by the Customer upon placing the order and is a condition for the performance of the Additional Service.
- The customer can place orders 24 hours a day using the form available on the website https://diagnostyka.genomed.pl.
- The procedure for the self-collection of the biological material by the customer is described in detail on the website https://diagnostyka.genomed.pl in the " How to Have Genetic Testing Performed?" part.
- Full instructions for transporting biological material are available on the website https://diagnostyka.genomed.pl in the " How to Have Genetic Testing Performed?/Shipping" tab.
- The biological material collected by the Customer, along with the " Declaration of Informed Consent" forms, should be sent to:

The package should be sent by courier or registered priority mail. Shipping costs are covered by the person ordering the test. - The genetic test result will be sent to the Customer to the address indicated on the form or to the Customer 's address given when ordering by phone or email. Test results can also be downloaded from the result delivery website at diagnostyka.genomed.pl/en or collected in person by the Customer at the Genomed S.A. office at ul. Ponczowa 12 in Warsaw.
- The kit will be delivered to the Customer to the address indicated in the order after payment for the ordered genetic test.
- GENOMED S.A. reserves the right to refuse to process an order if the customer fails to pay for the ordered service. In the event of refusal to process an order, GENOMED S.A. will notify the customer by email, telephone, or letter.
- GENOMED S.A. is bound by the placed order from the moment of the customer's payment confirmation.
- GENOMED S.A. may refuse to process the placed order if the order form has been completed incorrectly.
- The customer may correct the order if the kit has not yet been shipped by canceling all or a part of the order placed, changing the address for delivery by post or courrier, or changing the invoice information.
- A sales document is issued and attached to each order.
- All service prices are expressed in Polish currency and include VAT.
- A calculator is available on the website to convert prices from PLN to Euro and from PLN to USD.
- GENOMED S.A. is authorised to change the prices of services offered on the website https://diagnostyka.genomed.pl. In case of a price change for already ordered services, the customer will not be charged for additional costs related to price changes during the provision of the service.
- Promotions on the website https://diagnostyka.genomed.pl cannot be combined unless the Terms and Conditions of a given promotion state otherwise.
- Chapter 3. Making Payments
- GENOMED S.A. offers the following payment methods in Polish currency:

Credit card and e-transfer transactions are settled via the Dotpay (Przelewy24) Settlement Center. - Order processing will begin after diagnostyka.genomed.pl receives payment confirmation.
- Payments in Euro are accepted only by bank transfer to the following account:

Transfer costs are borne by the customer - Chapter 4. Order processing time
- Order processing time begins when the order is placed and ends with the delivery of the ordered kits to the customer. The standard processing time is 3 business days.
- The order processing time should be distinguished from the processing time for the genetic testing of the biological material delivered by the customer or collected from the customer. The processing time for each genetic test is specified on the website https://diagnostyka.genomed.pl in the "Genetic Tests" tab, which contains a full list of tests.
- Chapter 5. Right of Withdrawal
- A customer who has entered into a distance contract may withdraw from it within 14 days without providing a reason and at no cost.
- Withdrawal from the contract is possible only if:
- the genetic material has not been collected from the patient or, in the case of self-collection, if the kit has not sent to the Genomed laboratory
- the ordered kit, which is a single-use product, has not been used. Sealed kits must be returned in their original, undamaged packaging. The returned kit must be returned together with the sales document received with it.
- In the event of a total or partial cancellation of the order by the customer and if payment was made in advance, the refund will be made within 14 business days of receipt of the customer's cancellation, along with a correction invoice issued by GENOMED S.A. signed by the customer, and the DECLARATION. The refund will be made to the customer's account from which the payment was made. If the customer does not have a bank account, the amount due will be refunded via postal order to the address provided by the customer.
- Chapter 6. Complaints
- If a kit is missing or defective, the customer is asked to immediately contact GENOMED S.A. to file a complaint.
- The complaint will be processed within 14 days from the date of its submission by the customer.
- The kit with a technical defect will be replaced with another, full-value kit. If this is no longer possible (for example, due to stock shortage), GENOMED S.A. will refund the customer the price of the kit or offer them other available kits to choose from.
- The claimed kit will be collected from the customer at the GENOMED S.A. expense and only by the coutrier ordered by GENOMED S.A.
- If the complaint is rejected, the customer has the right to pursue his or her claims in proceedings before a court of competent jurisdiction in accordance with the provisions of the Code of Civil Procedure of general jurisdiction.
- Chapter 7. Final Provisions
- The customer is obliged to read these Terms and Conditions and is bound by their provisions at the time of placing an order.
- GENOMED S.A. also informs that the information contained on the website https://diagnostyka.genomed.pl does not constitute a binding offer within the meaning of the Civil Code for any entity, in particular offers of any services.
- The basis for any claims by the parties arising from legal provisions is the order confirmation delivered to the customer together with the ordered kit.
- GENOMED S.A. reserves the right to amend these Terms. Any changes to the Terms become effective 7 days after their publication on the website https://diagnostyka.genomed.pl. Orders placed before the date of entry into force of amended terms will be processed based on the previous terms.
- In matters not regulated in these terms, the Act of 23 April 1964, the Civil Code (Polish Journal of Laws of 1964, No. 16, item 93) and the Act of 30 May 2014 on consumer rights (Polish Journal of Laws of 24 June 2014) shall apply.
